Habib, released by the US from the base in Cuba without being charged, stepped off a large private jet at the Sydney Airport jet base at about 4pm (AEDT), about half an hour after the jet – marked only with a US flag – landed.
Bearded, wearing a white T-shirt, long dark pants and carrying a blue shirt, he emerged from the plane to be greeted on the tarmac.
He then went to a small propeller aircraft, accompanied by two men, and took off for an unknown destination.
As he stepped on to the tarmac he shook hands with at least one man before moving to the other aircraft.
Mr Habib was detained in Afghanistan in October 2001 and sent to Egypt before being flown to Guantanamo Bay in 2002.
Earlier his sister Sally Habib said she was excited by her brother’s return and there would be a big celebration tonight.
“When I see him I say I missed you so much and I’m glad to see him and, ah, hug him and kiss him. Thousand kisses and thousands of hugs. How many, three, three and a half years?” she told radio 2UE.
Habib’s family had made special arrangements to meet with him at an undisclosed location shortly after his arrival in Sydney, said Attorney-General Philip Ruddock.
“His family were informed that he was arriving and as was his legal practitioner,” he told radio 2GB.
“We understand they’ve made arrangements to spend time with him at an undisclosed location of their choosing.
“But he’s not in custody, he’s at liberty, and the exact whereabouts are really a matter for him and his family.”
Mr Habib would remain a person of interest, Mr Ruddock said.”He is not being arrested or charged,” he said.
“He remains a person of concern to security agencies, I’ve made that clear before.
“But the reason he wasn’t charged in relation to matters that we were familiar with – that is that he’s acknowledged that he spent time in Afghanistan and others have said that he spent time training with al-Qaeda – was that that was not an offence under our law before July 2002.”
Mr Habib was free to resume his normal life in Australia subject to laws in the same way as everyone else, Mr Ruddock said.
